These Terms of Use (“Terms”) govern your access to and use of Harmony Health’s websites, applications, and online tools (collectively, the “Applications”). By accessing or using the Applications, you agree to these Terms and to Harmony Health’s Privacy Policy. If you do not agree to these Terms, do not use the Applications.
If you access the Applications through a health care provider, employer, or health plan that has a separate agreement with Harmony Health (an “Enterprise Agreement”), that agreement controls in the event of a conflict. You remain individually bound by these Terms.
Important Notice Regarding Dispute Resolution
These Terms include an arbitration agreement, jury trial waiver, and class action waiver that affect your legal rights. Please review Section 10 carefully.
Not Medical Advice
Information available through the Applications is provided for general and administrative purposes only. It does not constitute medical advice, diagnosis, or treatment and does not replace care from your health care provider.
If you are experiencing a medical emergency, call 911 immediately.
Use of the Applications
You agree to use the Applications only for lawful purposes and in a manner consistent with these Terms. You may not attempt to access systems or data you are not authorized to use, interfere with the operation or security of the Applications, or use the Applications in violation of applicable law.
You are responsible for your own devices, software, internet access, and related costs.
The Applications are not intended for children under age 13. Minors may only use the Applications through a parent or legal guardian, where permitted by law.
Privacy and Health Information
Your use of the Applications is subject to Harmony Health’s Privacy Policy.
To the extent information you provide constitutes protected health information (PHI), it is handled in accordance with applicable law, including the Health Insurance Portability and Accountability Act of 1996 (HIPAA), and the Notice of Privacy Practices of your health plan or health care provider, which governs when applicable.
Communications Consent
By using the Applications or Portal, you consent to receive communications from Harmony Health related to scheduling, services, programs, and operations by phone, email, text message, or electronic notification, as described in our Privacy Policy. Message and data rates may apply.
You may opt out of certain communications as described in the Privacy Policy, except where communications are required in order to provide services.
Availability; Changes
The Applications and their content may change at any time without notice and may be unavailable from time to time. Harmony Health has no obligation to update any information.
The Applications are provided “as is” and “as available.”
Disclaimer of Warranties
To the fullest extent permitted by law, Harmony Health disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Harmony Health does not guarantee that the Applications will be uninterrupted, error-free, secure, or accurate.
Limitation of Liability
To the maximum extent permitted by law, Harmony Health and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Applications, under any legal theory, even if advised of the possibility of such damages.
These limitations are a fundamental part of the Terms.
Third-Party Services
The Applications may include links to or integrations with third-party services. Harmony Health does not control and is not responsible for third-party content, services, or privacy practices. Your use of third-party services is subject to their terms.
Arbitration; Waiver of Jury Trial and Class Actions
Any dispute arising out of or relating to these Terms or the Applications will be resolved through binding individual arbitration, not in court, except where small claims court is permitted.
You waive the right to a jury trial and the right to participate in class, collective, or representative actions. Arbitration is governed by the Federal Arbitration Act and administered by a recognized arbitration provider under its applicable rules.
You may opt out of arbitration by sending written notice within 60 days of first agreeing to these Terms, as described in the full arbitration policy available on our website.
Termination
Harmony Health may suspend or terminate access to the Applications at any time, with or without notice. Upon termination, these Terms continue to apply to prior use.
Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-laws principles.
